Terms and Conditions for The Referral Choice Directory Website
- Acceptance of Terms
By accessing or using REFER.HEALTH, LLC’s services (hereinafter referred to as “Provider”), you (hereinafter referred to as “Customer”) agree to comply with and be bound by the following terms and conditions (the “Terms and Conditions”). - Services Provided
The Provider offers a directory service for businesses that provide medical and non-medical care, assisting in the referral process to ensure individuals are discharged to appropriate settings or offered community resources. Users can upload and display information about their business on the Provider’s database, accessible via the Customer’s individual dashboard. - Authorized Users
The intended users of the services include case managers, medical assistants, social workers, nurses, and physicians. Customers may authorize certain employees, consultants, contractors, and agents to use the services, provided they are properly authorized and their access is in compliance with these Terms and Conditions. - Use of Services
The services are provided for the internal use of the Customer only. Customers are prohibited from:
Spamming or copying information from another paid user.
Posting any patient information, such as names or dates of birth.
Posting content that negatively portrays another company to benefit their own. - Account Management
Paid users must update their dashboard at least once a week to ensure all information is accurate and up-to-date. Failure to maintain accurate information may result in suspension of services. - Content and Data
Paid service providers may submit content such as employee photos, pictures of community services, “about you” sections, QR codes, and links to their website. All submitted content remains the intellectual property of the Customer, but the Provider is granted a license to use this content for service delivery purposes. - Data Privacy
User data, including clicks and views, will be stored and used for performance tracking and service improvement. A separate privacy policy governs the handling and protection of personal data. - Payment and Fees
The fee structure is as follows:
Standard Annual Fee: $2,400 per year, payable in monthly installments of $200.
Personal Care Homes: Pricing varies based on the number of beds.
1-4 beds: $50/month
5-9 beds: $100/month
10-14 beds: $150/month
15+ beds (considered assisted living): $2,400/year
Special Promotions: The first 10 customers in each service type can lock in a discounted rate of $2,000 per year. - Refund and Cancellation Policy
There are no cancellations or refunds. Customers must provide a 30-day notice before their renewal date if they wish to cancel for the next 12 months. Reapplying customers who were in the top 10 but canceled will be required to pay the full current rate upon reapplication. - Intellectual Property
All intellectual property related to the services provided by the Provider remains the property of the Provider. However, any content created and submitted by the Customer remains the Customer’s intellectual property. - Service Availability and Support
The services will generally be available during regular business hours. Support is available via email at [email protected] from 9 AM to 5 PM CST. Emails will be responded to within 24 hours. - Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the State of Texas. Any legal disputes will be resolved exclusively in the courts of Galveston County, Texas. - Dispute Resolution
Any disputes arising from these Terms and Conditions will first be attempted to be resolved through mediation. If mediation fails, the dispute will be submitted to binding arbitration. - Amendments to Terms
The Provider reserves the right to amend these Terms and Conditions at any time. Customers will be notified of any changes via email. - Force Majeure
In the event of force majeure, including the death of the owner or bankruptcy of the company, all services will be terminated if a new responsible party is not determined in writing. The Provider is not liable for any failure or delay in performance due to circumstances beyond its control. - Third-Party Services
The Provider may integrate third-party services into the platform in the future. Customers acknowledge that the Provider is not liable for any issues arising from third-party services. - Special Promotions
Customers who join the “50’s Club” (the first 10 customers in each service type) will lock in a rate of $2,000 per year for the lifetime of the company, provided they maintain continuous service and do not cancel. - Customer Support
Customer support is available via phone or email during business hours. Customers can contact support for any issues or questions related to their account or services.
